This “Site” and related services are made available to you in accordance with the following Terms of Use, and any other rules posted on our “Site”.
If you do not agree to any of the stated Terms and Conditions you may not use or access this website.

The Website  www.shopthecodemag.com is solely for personal use and may not be used for non-commercial or any other uses. Please note that these Terms and Conditions do not affect your statutory rights as a consumer.

This Site brings together our digital publication “the CODE” as well as products offered for sale by certain third party brand retailers and/or their websites who we feature on the Site (“Affiliates“, “Boutiques”) to help users who visit the Site (you, your) browse, locate and purchase selected products either from us or from any of those Affiliates.

1.2. If you are under 16 you must let your parent or guardian know about the Site’s Privacy Policy before you register to use this Site or any of this Site’s services. We reserve the right to only accept orders from those over 18 however.

1.3. We reserve the right, at our sole discretion, to change, modify, add, amended or remove any part of these Terms of Use from time to time, without notice. The date of the most recent revision will appear on the top of this page.

2.1. The purchase of any of the product(s) offered for sale on this Site by Affiliates or Boutiques (Products) is subject to the Affiliates/Boutiques Terms. By placing an order for any Product you agree to be bound by the Affiliates/Boutique Terms. So please, read the Affiliates/Boutique Terms carefully. We advise that you print a copy of these Affiliates/Boutique Terms for future reference.
2.2.  The purchase of any of the product(s) offered for sale on this Site directly by us, BEAUTENET BOUTIQUE, is subject to our own Terms of Supply, and not the Affiliate/Boutique Terms. On each product page, you can see clearly whether an item is offered for sale by us or by an Affiliate/Boutique.

The use of the Site itself is subject to our Website Terms of Use. The use of your personal information submitted to or via the Site, is governed by our Privacy and Cookies Policy.  All products we sell are genuine and supplied by the brand owners, manufacturers or authorized distributors.

2.3.  When a Product is sold by an Affiliate, you will buy directly from that Affiliate (not from us) and the contractual relationship in relation to the sale will be only between you and that Affiliate. We will not be a party to it. The relevant Affiliate will be responsible for the sale, the delivery and other after-sale care and our role is limited to acting as commercial agent.

When a Product is sold by a Boutique, you will buy directly from that Boutique (not from us) and the contractual relationship in relation to the sale will be only between you and that Boutique. We will not be a party to it. The relevant Boutique will be responsible for the sale, the delivery and other after-sale care and our role is limited to acting as commercial agent to conclude the sale by accepting your order and collecting your payment on behalf of the relevant Boutique. Our receipt of full payment from you will discharge your debt to the relevant Boutique in respect of that order. Though we may assist with after-care issues on behalf of the relevant Boutique, you do not have any contractual rights against us regarding any Product sold on the Site by any Boutique.
2.4. We take every care to ensure that the product images, description and specification of each product listed on the Website are accurate. However, although the colors in images on Website are a close representation a slight difference may occur in the actual product you receive. We always recommend trying the products that we sell in store before purchasing online.
 
2.5. By submitting an order to us through our Site, you confirm that you are the person referred to in your billing details and all of your details are valid and correct.
 
2.6. We take reasonable care to make our Site secure. To help ensure that your shopping experience is safe, simple, and secure, the Site uses Secure Socket Layer (SSL) technology. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

3. ORDERS

 
3.1. All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.
 
3.2. Prior to placing your first order on the Site, you may choose one of the two following options. You may either proceed to the checkout as a guest user, or register to create an account and proceed to checkout. Should you choose the latter of the two, you will be able to access your account at any time by using your login details (email address and password). Please see our Privacy and Cookies Policy for details about the personal information we collect from you and how we use that information.
 
3.3. The Site offers products for sale that are in stock and available for dispatch otherwise an “out of stock” notification is shown on product tables. Occasionally however, some products may be out of stock or discontinued by the supplier and still be shown as “in stock”. In case you order an out of stock item, we will contact you to inform you that is out of stock and let you know if any replacement products are available.  For those products that may be waiting for shipments from our suppliers, a “coming soon-notify me” notification is shown on product tables. You may simply choose to register your email address for notification of arrival of the selected merchandise not held in stock.
 
3.4. If an order contains both in stock and out of stock products, the in stock products will be dispatched initially and the out of stock will follow once we have received stock
 
3.5. Unless you cancel your order, acceptance of your order and completion of the contract between you and the Site will be completed when we email you to confirm the goods have been dispatched.
 
3.6. We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the identification of pricing or product listing error, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out in our ‘Terms and Conditions’.
 
3.7. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion.  We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
 
3.8. Online Order 
Shortly after you place an order through the Website, an order confirmation will be sent to you acknowledging the exact details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.
 

3.9 Boutiques
The contract between you and the relevant Boutique for the purchase of Products on the Site (Contract) will only be formed when, on behalf of the relevant Boutique, we send you the Acceptance and Dispatch Confirmation Email and collect the payment. After entering into the Contract, the relevant Boutique will be under a legal obligation to supply you with goods that conform to the Contract.

The Contract will relate only to those Products which we, on behalf of the relevant Boutique, have confirmed in the Acceptance and Dispatch Confirmation Email. The relevant Boutique will not be obliged to supply any additional Product(s) which may have been part of your order.

If your order includes any Product(s) not available in stock or which have been discontinued once payment has been taken, we or the relevant Boutique will refund you in relation to the Product(s) which are unavailable, and suggest suitable alternatives.

4. ORDER CANCELLATION
 
If you wish to cancel your order please contact our Customer Service Team immediately by telephone – Monday to Friday 9.30am-6.00pm or by email: customercare@beautenet.com including your order number and cancellation reason.
 
 
5. PAYMENT METHODS
 
 
The Site currently uses the following methods of payment :
1. Cash on Delivery (Only for Greek residents)
2. Deposit to BEAUTENET’s Bank Account

For the order to be valid, the transaction sheet with your full name, your order number and grounds for deposit should be sent to the following email address: customercare@beautenet.com
Orders will be processed only after BEAUTENET has received the aforementioned transaction sheet as well as bank confirmation. Consequently, delivery time starts counting from that moment. 
3. Paypal System.
Payment can be made by any credit/debit card or method accepted by Paypal system.
When you use PayPal Services, Paypal collect information sent by your computer, mobile phone or other access device. 
In addition, if you open a PayPal account or use PayPal Services, they may collect the following types of information:
a) Contact information, such as your name, address, phone, email, and other similar information.
b) Financial information, such as the full bank account numbers and/or credit card numbers that you link to your PayPal account or give us when you use PayPal Services.
c) Detailed personal information such as your date of birth or social security number.

6. PRICING POLICY

 
6.1. Prices shown on the Site are in Euros and are inclusive of VAT at the applicable rate (24%)
 
6.2. Although we do our utmost to ensure all prices shown on our Website are accurate, errors may occasionally occur. If we discover an error in the price of a product you have ordered, we will contact you as soon as possible. If we do not receive a response to our contact within 7 days we may consider your order, in respect to the incorrectly priced item as cancelled.
6.3. Product prices are subject to change.
– Customers purchasing from a country served as DDP will incur relevant import duty and tax. These costs are included in the final purchase price.
– Customers purchasing from a country served as DDU will be charged for the items purchased and shipping costs only. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. Please note that any customs charges are payable by the buyer and we take no responsibility for these charges.
 
7. DELIVERY
 
7.1. We offer Europe and Worldwide delivery, however restrictions do apply.
 
7.2. Please note that we aim to dispatch all orders within 3-4 days. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Delays may occur.
 
7.3. BEAUTENET is not responsible for any delays caused by destination customs clearance processes.
7.4. Delivery time depends on the shipping company we cooperate with and the information provided by the carriers.
BEAUTENET therefore bears no responsibility for any delay on the part of transportation companies. The delivery times do not include Sundays and holidays.
 
7.5. The customer must provide accurate delivery address when placing the order, and be available to receive the parcel when it arrives.
7.6. Upon receipt of the order and the presence of the distributor, you are obliged to check the condition of the goods before signing the delivery document and therefore accept the parcel. We advise that you do not limit yourself only to the control of the state outside of the package, since it not necessarily reflects the condition of the goods inside.
 
7.7. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by BEAUTENET, and transfer of responsibility in the same way.
 
8. INTERNATIONAL DELIVERY
 
8.1. For International Deliveries, we cooperate with DHL and HELLENIC POST Registered First Priority Service.
 
8.2. All shipping costs shown on the shipping cost table are referred to orders up to 1kg. If your order exceeds this weight it may be held while we contact you to take extra payment.
 
8.3. A tracking number will be provided on dispatch.
 
8.4. Hellenic Post Registered Service is not a fully tracked service. It depends on the country of delivery and the local delivery services. We are sorry but we can’t provide any assistance with your local delivery service.
 
8.5. Deliveries outside EU are subject to customs, legal, regulatory and certain practical restrictions. To comply with local legislation, you or the recipient may be required to pay additional taxes, fees, import duty or formal customs entry may apply to all products purchased from us. Please ensure that you enter the correct international delivery address and postcode. If the address is entered incorrectly or if customs duties or formal customs entry are required, the delivery may be delayed. We are unable to offer you any assistance if either issue arises.
 
8.6. Please note that any customs charges are payable by the buyer and we take no responsibility for these charges. If an order is returned due to these not being paid, no refund will be made for delivery charges and reserve the right to charge any additional costs.
 
8.7. We are sorry, but we can’t change the delivery address of a parcel once your order has been processed.
8.8. If an incorrect, incomplete or invalid address is given for delivery we are unable to process any claims for the parcel not being delivered, please let us know however and we will contact you if it is returned to us.
 
8.9. We are unable to process any claims for non delivery if your order is delivered to a work address, student halls, block of flats or other building with a communal delivery point and the tracking on your order is confirmed as delivered.
8.10. Please note that many countries have import restrictions on certain products or materials. You are responsible for checking with the local customs authorities before placing an order for international delivery. We are unable to offer you any assistance in this regard.
 
8.11. If the international delivery is outside the EU, it is advisable to keep your total basket value below the customs duty threshold of the destination country. Please check thresholds and duties for the international delivery address before placing an order. You are responsible for assuring that the product can be lawfully imported to the destination country. When ordering from us, the recipient is the importer of record and must comply with all laws and regulations of the destination country.
8.12. We take no responsibility if customs open a parcel, remove any contents or destroy restricted goods, these vary from country to country and as such are the buyers responsibility to find out. We will not process any claims for missing items if a parcel has been opened by a customs department, this is the recipients duty to claim with the relevant custom department.
 
8.13. There is maximum weight limit on international orders of 2kg, if your order exceeds this weight it may be held while we contact you to take extra payment.
 
8.14. We will try our best to send all your products in a single delivery. The only reason we’d split deliveries is if they were over the carrier’s size and weight restrictions – or if a product is out of stock, in which case we will contact you to let you know. 
If an item on your order is out of stock it will be dispatched as soon as we receive new stock and the delivery will be using the standard service.
8.15. If your order has not been delivered within the estimated time we have to allow 40 working days from dispatch before we can consider an order to be lost. Deliveries to Asia are currently taking longer than normal for delivery as such we have to allow 45 working days from dispatch before we can consider an order to be lost. All claims for the non-delivery of an order need to be made with 90 days of the dispatch date or we will not be able to process the claim. If the tracking shows the parcel as delivered we are unable to process any claims for non-receipt of the parcel.
 
8.16.  Any orders containing fragrances or nail varnishes may be upgraded to our registered service.
 
8.17. Please also note that for international deliveries: any manufacturer warranty may not be valid; manufacturer service options may not be available; product manuals, instructions and safety warnings may not be in destination country languages; and the products (and accompanying materials) may not be designed in accordance with destination country standards, specifications, and labeling requirements.
 
9. RETURNS POLICY
 
9.1. For hygiene reasons, items can only be returned if they are unopened, unused and in re-saleable condition with all tamper resistant seals, packaging and any cellophane intact and unopened.
 
9.2. If a product is returned that is not in its original condition, unopened and in the original packaging, with all tamper-resistant seals and any cellophane intact then we will not be able to process a refund or replacement for the item and it will be returned to you with the redelivery charge being paid by yourself.
 
9.3. Refunds for unwanted items will not include the cost of delivery or return postage.
 
9.4. If you wish to return or replace an item, please complete the “Contact Us” form and include an explanatory note quoting your order number.
Items must be returned within 14 days of order receipt.
 
9.5. We do not offer a free returns service. We recommend that you post any returns to us using a method that is trackable or alternatively obtain a “certificate of Posting”, as we cannot be held responsible for any items without proof of posting.
 
9.6. Returns are usually processed within a few days of receiving the goods back. Refunds can take up to 1 week to show on your account; this is due to the time taken by some banks to process the payment. We will refund you by the same payment method used to make the original order (e.g. if you have paid by PayPal, we will reimburse your PayPal account).
 
9.7. The refund will not include the cost of delivery or return postage.
 
9.8. All orders dispatched are recorded on video and every item on the order is scanned prior to being packaged to prevent errors. In the unlikely event you receive your order with a part missing or an incorrect product please contact our Customer Care Team who will then review the video footage and investigate the error and contact you with a suitable resolution.

10. JURISDICTION
 
The Site and Customer Care Team are controlled and operated in Greece. These Terms and Conditions (including full delivery terms and conditions) and all matters connected with any order that is placed through the Site or via the telephone are governed by Greek law and you agree to submit to the exclusive jurisdiction of the Greek courts in relation to all matters connected with or arising out of the Website or your use of customer services or any order you place through the Website or through Customer Services.
